Terms of Service for JVLStays.com

Operated by JVL Real Estate B.V. (the "Company") Incorporated in the Netherlands

1. Scope and Contract Formation

These Terms of Service govern all bookings made through JVLStays.com. A binding rental contract is created when the Company receives full or required initial payment from the person making the reservation (the "Primary Guest"). The Primary Guest warrants that they are authorized to act on behalf of the entire travel group and accepts responsibility for the group’s compliance with these Terms.

2. Definitions

  • Accommodation: the property, unit or space offered for short-term recreational stay.
  • Guest: the individual or group staying at the Accommodation under a confirmed booking.
  • Booking: the confirmed reservation between the Guest and the Company.
  • Price: total amount payable for the Booking, including fees, taxes, and any optional services ordered unless explicitly excluded.
  • House Rules: specific behavioral and operational requirements provided to Guests for the Accommodation (including noise, occupancy, cleanliness, and prohibited activities).
  • Pool & Wellness Rules: safety and hygiene rules applicable to any pool, jacuzzi or related amenities.
  • Force Majeure: events beyond the reasonable control of the Company such as natural disasters, strikes, pandemics, government restrictions, utility failures, or other unforeseeable circumstances.

3. Use and Occupancy

Accommodation is provided strictly for short-term recreational use. Maximum occupancy limits, minimum age requirements, and any restrictions noted in the listing or confirmation must be followed. Subletting, unauthorized events, or use inconsistent with the intended purpose is prohibited.

4. Payment and Security Deposit

Payment terms are set out in the booking confirmation. Unless otherwise stated:

  • A non-refundable deposit or full payment may be required at booking.
  • Remaining balance is due no later than 30 days before arrival.
  • A security deposit or damage protection (refundable or held as authorization) may be collected to cover damage, excessive cleaning, or violations of these Terms. Deductions will be itemized and communicated within 14 days after departure.

5. Cancellation and Rebooking

Guests may cancel their Booking in writing. Cancellation charges are:

  • More than 45 days before arrival: 10% of the Price or a fixed administrative fee (whichever is higher).
  • Between 14 and 45 days before arrival: 50% of the Price.
  • Less than 14 days before arrival: 100% of the Price. If the Accommodation is rebooked for the same dates at equal or higher value, the Guest may receive a credit or partial refund less administrative costs. Credits expire after 12 months and are non-transferable.

6. Changes by Guest or Company

Minor changes requested by the Guest (dates, guest count) are subject to availability and may incur a fee. The Company may make reasonable adjustments to the Booking (e.g., alternative but comparable Accommodation) if the originally booked unit becomes unavailable, with notice and without additional cost to the Guest.

7. Check-in, Check-out, and Early Departure

Check-in and check-out windows are provided in the confirmation. Early departure does not automatically entitle the Guest to a refund. Late check-out may incur additional charges if not pre-approved.

8. Guest Responsibilities and Conduct

Guests must:

  • Comply with all House Rules and Pool & Wellness Rules.
  • Keep the Accommodation in a clean, tenantable condition.
  • Prevent damage and promptly report any issues to the Company.
  • Respect neighbors: excessive noise, disturbances or illegal activity may lead to immediate eviction without refund.
  • Secure all keys and access credentials; lost keys may result in replacement charges.
  • Use provided utilities and equipment responsibly.

9. Access and Inspection

The Company or its agents may access the Accommodation with reasonable notice for maintenance, safety inspections, or to investigate complaints. In emergencies, access may be immediate without prior consent.

10. Termination and Eviction

The Company may terminate the Booking and require immediate departure (without refund) if:

  • Guest or their party violates these Terms, House Rules, or applicable laws.
  • The Accommodation is used for unlawful purposes or unauthorized gatherings.
  • The Guest causes significant nuisance, damage, or safety risks. Termination will be communicated in writing or verbally if urgent. Eviction expenses and any damages remain the Guest’s responsibility.

11. Liability and Insurance

  • The Company’s liability for direct losses is limited to the amount paid by the Guest for the Booking, except in cases of gross negligence or willful misconduct.
  • The Company is not liable for indirect, consequential, or incidental damages (including lost travel time, personal belongings, or business loss).
  • Guests are advised to obtain travel, health, and personal liability insurance covering their stay.
  • The Company is not responsible for disruptions caused by Force Majeure.

12. Data Privacy

The Company collects and processes personal data necessary for the Booking in accordance with its Privacy Policy and applicable data protection laws (including GDPR). Guests consent to such processing by completing a Booking. Identification information may be required for registration with local authorities when legally mandated.

13. Intellectual Property

All content, branding, and materials on JVLStays.com are owned or licensed by the Company. Use without explicit permission is prohibited.

14. Complaints and Dispute Resolution

Guests must raise complaints promptly during their stay to allow the Company an opportunity to remedy the issue. Unresolved disputes may be escalated in writing within 12 months of the incident. Parties agree to seek amicable resolution first. If that fails, disputes will be adjudicated under Dutch law in the competent Dutch courts unless arbitration is mutually agreed in writing.

15. Amendments to Terms

The Company may update these Terms from time to time. Changes do not apply retroactively to confirmed Bookings unless agreed in writing. Updated Terms will be published on the website with an effective date.

16. Governing Law and Jurisdiction

These Terms are governed by Dutch law. Unless otherwise agreed, disputes are subject to the exclusive jurisdiction of the competent courts in the Netherlands.

17. Miscellaneous

  • Headings are for convenience and do not affect interpretation.
  • If any provision is found invalid, the remainder remains in force.
  • No waiver of rights is effective unless in writing.

By completing a booking, the Primary Guest confirms acceptance of these Terms on behalf of the entire travel group.
